Preferred Contractors

1. The agent has a relationship, connection or affinity with the service providers listed below. This is a non-financial interest unless noted otherwise. That is, these businesses and contractors are used by our office on a regular basis. If the Agent is required at any time to provide repairs and/or services with permission from the relevant party on of these businesses or contractors may be called to carry out the required work.

The agent does not accept any responsibility for problems or dissatisfaction with these services. Any dissatisfaction should be taken to the service provider directly.

1. The agent may have a connection, relationship or affinity with the buyer or tenant. These may be seen as a probable conflict of interest due to a possible financial gain received by the company and/or sales representative in the past or future: –

Previous client either as a buyer or seller or tenant
An investor who may or may not have the property managed by this company
Is a friend or has an ongoing relationship with the agency or representative, but does not require disclosure under the Act

2. The agent has a connection or affinity with and potentially benefits from;

Landlord Insurance Providers:
EBM Insurance, Terri Scheer, TICA Insurance
Potential Benefit: $30.00 each

Depreciation Schedule Providers:
BMT Tax Depreciation, Deppro
Potential Benefit: $30.00 each

Utilities Connection:
Connect Now
Potential Benefit: approximately $18
Related Parties:

Elders Home Loans and Elders Insurance
Potential Benefit: the above adds to Elders overall business performance, with SDEA Nominees a wholly owned subsidiary of Elders Ltd.

Assignment

3. Despite anything else in this Agreement “The Agency” may assign its rights under this Agreement to another company in “The Agency’s” corporate group provided that:

(a) the assignee is licensed under the Real Estate and Business Agents Act 1978 (WA);

(b) the assignee agrees:(i) to perform the duties of (The Agency) pursuant to the Agreement; and

(ii) to assume the accrued liabilities of “The Agency” in connection with the Agreement, from the date the assignment takes effect; and

(c) “The Agency” has given the Owner at least 28 days’ written notice prior to the assignment taking effect.

4. If the Owner objects to the assignment, the Owner may, by written notice given to “The Agency” at least 7 days prior to the assignment taking effect, terminate this Agreement.

5. To help give effect to an assignment under clause 1 above, the Owner:

(a) authorises “The Agency” on and from the date the assignment takes effect:

(i) to withdraw from its trust account monies held on the Owner’s behalf; and

(ii) to pay those monies to the assignee’s trust account;

(b) authorises the assignee to receive those monies in in its trust account on the Owner’s behalf, and to deal with then as if it were named as “The Agency” in this Agreement; and
